RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-04160 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: Additional inactive duty training points be added to her record of Air Force Reserve (AFRES) service for the anniversary year ending on 14 April 1993. APPLICANT CONTENDS THAT: All of her Unit Training Assembly (UTA) points are accounted for except for January 1993 and two (2) points in February 1993. She believes this is an error. If not corrected it denies her a creditable year of service for 1992 through 1993. She resigned from the Air Force Reserve in April 1993 when she found out she was pregnant. In support of her request, the applicant submits copies of her enlistment order, assignment order and documents pertaining to her point credit summary. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is a former member of the Air Force Reserve who served from 6 May 1991 until her resignation on 14 April 1993. The remaining relevant facts pertaining to this application are contained in the letter prepared by the appropriate office of the Air Force at Exhibit C. AIR FORCE EVALUATION: ARPC/DPTS recommends denial. DPTS states the applicant claims her AF Form 526, ANG/USAFR Point Credit Summary, does not reflect all of the Unit Training Assemblies (UTAs) she performed during the retirement year ending 14 April 1993. She alleges two (2) points for 7 February 1993 should be recorded, along with an unstated amount of points for the January 1993 UTA. However, the applicant has not provided documentation to verify her participation for the missing dates. They contacted the applicant on 24 October 2013, to determine if she, in fact, could produce the documentation for administrative relief. The applicant does not have the proof required. If a member does not have a Leave and Earnings Statement verifying participation, he/she can send an inquiry to AMPO-VERIFY-INQUIRIES@dfas.mil, requesting proof-of-pay for those specific dates. The applicant stated she previously contacted DFAS but must try again for proof-of-pay. The burden of proof is with the applicant. As stated on the point credit summary, the member was instructed to review the summary and report errors within 30 days of receipt. The complete ARPC/DPTS evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 21 February 2014, for review and comment within 30 days (Exhibit D). To date, a response has not been received. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took careful notice of the applicant’s complete submission in judging the merits of the case; however, we note the Air Force office of primary responsibility recommends denial because the applicant did not provide any documentary evidence to substantiate her request. In view of this, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our decision that the applicant has failed to sustain her burden of having suffered either an error or injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the relief sought in this application. However, the Board is willing to reconsider the applicant’s request should she produce the documentation to verify her participation during the missing dates. THE BOARD DETERMINES THAT: The applicant be notified that the evidence presented did not demonstrate the existence of material error or injustice; that the application was denied without a personal appearance; and that the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
